Please note that this affects ‘All remote licences except any lottery licence the holder of which only provides facilities for participation in low frequency or subscription lotteries’.

This means that hospices running the usual weekly subscription draw are not affected by this amendment. It is, as always, important that Hospices read carefully and decide for themselves if their lottery operation is affected by changes to the LCCP and to take appropriate steps as needed.

Where operators (both licensed and unlicensed) are offering to install lottery ticket vending machines in public houses on a ‘profit share’ basis this could be seen as committing lottery offences by promoting unlawful lotteries (contrary to section 258 of the Act) and/or misusing lottery profits (contrary to sections 260/261 of the Act).
